A Nairobi court has determined that three police officers from Jogoo Road Police Station have a case to answer regarding their alleged involvement in the escape of Masten Milimo Wanjala, a self-confessed killer.
The officers Philip Mbithi, Kamakia Mutuma Boniface, and Precious Mwende Mwinzihave been directed by Milimani Senior Principal Magistrate Robison Ondieki to present their defense after the prosecution provided sufficient evidence to establish a prima facie case against them.
Magistrate Ondieki stated that the prosecution proved the officers willfully neglected their duty to prevent Wanjala’s escape during the night of October 12-13, 2021.
The charges include aiding a remandee’s escape and negligence of duty. The officers are scheduled to present their defense on Friday, September 27, 2024.
Wanjala, who was in custody for the murder of at least 12 children, escaped just before he was set to enter a plea.
After his escape, he was reportedly killed by a mob in his rural home in Bungoma County.
During the trial, the officers claimed a blackout at the station on the night of Wanjala’s escape hampered their ability to monitor the suspects.
They argued that the lack of lighting forced them to use phone flashlights to conduct their duties.
