Court Postpones Sh106 Million Fraud Case Against Businessman Jonathan Ngenga

A Nairobi court on Friday postponed the hearing of a Sh106 million fraud case against businessman Jonathan Ngenga Ndisya and accountant Peter Kamau.

Milimani Chief Magistrate Lucas Onyina granted the adjournment after Ngenga told the court that his lawyer, Joe Mwangi, had an urgent matter upcountry and could not attend.

“Your Honour, my advocate has not been able to attend today’s court after he got an emergency from his upcountry and had to rush home to attend to it. It’s my prayer we postpone the hearing to another date,” Ngenga said.

The magistrate granted the request and rescheduled the hearing for March 2, 2026, to be conducted virtually.

Ngenga and Kamau face multiple charges, including conspiracy to defraud, obtaining money by false pretences, and fraudulent accounting.

According to the charge sheet, between July 1, 2018, and March 31, 2020, Kamau, while employed as an accountant at Agro Irrigation and Pump Services Limited and serving as a director at Joncil Enterprises, allegedly conspired with Ngenga to defraud the company of Ksh106,822,690.

The pair is accused of falsely claiming that Joncil Enterprises had deposited the said amount for goods supplied.

Ngenga is further charged with obtaining money by false pretences, pretending that the payment had been made into Agro Irrigation’s account between July 1, 2018, and March 12, 2020.

Kamau is also facing separate theft allegations.

He allegedly transferred Ksh4,777,094 from Agro Irrigation into his personal account during his employment between January 1, 2015, and December 31, 2019.

During the same period, while working at Desire Flora (K) Limited, he is accused of stealing Ksh3,500,000, money which came into his possession by virtue of his employment.

In addition, Kamau faces a count of fraudulent false accounting to show that Joncil Enterprises had paid Ksh106,822,690 to Agro Irrigation, when in fact no such payment had been made.
