DPP Renson Ingonga Declines to Drop Fraud Charges Against Former Java CEO Derrick Houten

Director of Public Prosecutions Renson Ingonga has decided not to drop the fraud charges against former Java CEO Derrick Cornelius Van Houten, who is accused of defrauding businessman Awil Abdirahman Adulle of Sh 7.9 million.

On Monday, September 16,2024, State prosecutor Nancy Kerubo informed Milimani Chief Magistrate Lucas Onyina that after reviewing the case file, there is sufficient evidence to proceed.

Ingonga rejected Houten’s request to dismiss the case, noting that it is similar to another pending case.

The DPP has requested that the case be consolidated with another case (number E14 of 2024) for further proceedings.

Magistrate Onyina has decided not to withdraw from the case but has referred it to Magistrate Gilbert Shikwe for further directions.

Houten faces accusations of obtaining Sh 7,911,000 from Adulle under the pretense of helping to construct a Java Hotel in Narok between 2021 and 2022.

The alleged offense occurred between October 1, 2021, and January 31, 2022, while Houten was CEO of Java.Houten, who is out on a cash bail of Sh 500,000, is scheduled to return to court on October 19 for the case consolidation and further hearing.
