Court Blocks Wanjigi from Entering Plea on Felony Charges

The High Court has issued a fresh order halting businessman Jimmy Wanjigi from pleading to charges related to creating a disturbance and felony offenses.

Justice Bahati Mwamuye stated, “Pending hearing inter partes, an order of prohibition is hereby issued against the DPP barring it from instituting any criminal charges or continuing any criminal prosecution against Wanjigi relating to the subject matter of the petition.”

The judge clarified that Wanjigi would not take his plea in the magistrate’s court during today’s proceedings.

Additionally, Justice Mwamuye extended orders preventing Wanjigi’s prosecution in a separate firearms-related case.

At the time of the High Court’s ruling, Wanjigi was present in the magistrate’s court, seated before Chief Magistrate Susan Shitubi, who had postponed her ruling on whether he would enter a plea.

The magistrate ultimately refrained from delivering her decision after receiving the High Court order.

Wanjigi had been arrested last month but was subsequently released on a Sh10 million bond after his plea was deferred.

His advocate, Willis Otieno, argued that during a police raid on Wanjigi’s home, the only items confiscated were iPhones, iPads, and three flags, asserting that the firearms in question were planted by law enforcement.

The High Court’s orders will remain in effect until the multiple applications filed before Justice Mwamuye are fully heard and determined.
