Real Estate Director and Politician Files Defamation Suit Against Law Society of Kenya

A director of a real estate company and aspiring politician has filed a defamation suit against the Law Society of Kenya (LSK) before the Milimani High Court, seeking compensation for damages.

Stephen Mwangi Kimani, a real estate agent with Eldolim Properties, filed the case under certificate of urgency, asking the court to order the respondents to remove defamatory social media posts from their Facebook accounts.

Kimani also sought interim orders to maintain the status quo until the suit is heard and determined, along with a request for the costs of the application to be awarded. Milimani High Court Judge Stella Mutuku has scheduled the hearing for Tuesday, March 18, 2025.

In his affidavit, Kimani claimed that his name was falsely published on a Facebook group, Kwambira/Kamirithu Notice Board, which has about 70,000 subscribers.

The posts falsely alleged that he was masquerading as an advocate, damaging his reputation.

Kimani named the LSK and Joseph Karanja Muchai, the administrator of the group, as the parties responsible for the defamatory publication.

He argued that Muchai, a close associate of his political rival in Limuru Constituency, has been involved in spreading misleading information to harm his political ambitions ahead of the 2027 elections.

In the affidavit, Kimani also detailed an incident on February 14, 2025, when LSK members reported to the Limuru Police Station, accusing him of posing as a member and advocate.

However, after an investigation, the police found no basis for the accusations, cleared Kimani of any wrongdoing, and released him.

Kimani further alleged that LSK members took his photos without consent while he was at the police station, and after his release, they continued to circulate these images online, falsely branding him as a masquerader.

Despite his requests for the posts to be taken down, Kimani claims the respondents have not removed the defamatory content and have continued to post new defamatory material.
