The Judiciary has expressed deep concern over a recent statement by the Law Society of Kenya (LSK) calling for its members to occupy the Supreme Court of Kenya in protest against the Court’s recusal from hearing matters involving Ahmednasir Abdullahi, SC, and his law firm.
In a press release issued on January 23,2025, LSK urged its members to take to the Supreme Court to protest the decision, claiming that it undermines the rule of law.
The Judiciary has pointed out, however, that the issue is currently before multiple courts, including the High Court, Court of Appeal, and the East African Court of Justice, and remains unresolved.
The Judiciary on Monday January 27,2025 emphasized that the cases are still under judicial consideration and it is essential for the Law Society of Kenya to refrain from actions that could disrupt the legal process.
They have called on LSK members, as officers of the Court, to respect the sub judice rule and allow the courts to address the matter through lawful and peaceful means.
“The matter remains before the courts, and it is critical to observe the rule of law. We urge LSK to respect the judicial process and resolve any concerns through appropriate, peaceful channels,” said Judiciary Spokesperson, Hon. Paul Ndemo.
This statement by the Judiciary underscores the importance of maintaining the independence of the courts and ensuring that legal proceedings are allowed to unfold without interference.
