Supermetro Sacco operators have been cleared to resume their Public Service Vehicle (PSV) operations following a ruling by the Transport Licensing Appeals Board (TLAB).
In a ruling by the board led by its chairman Adrian Kamotho temporarily lifted the suspension imposed by the National Transport and Safety Authority (NTSA), allowing the Sacco’s buses to return to the roads.
“Pending inter-partes hearing of the Motion and the Memorandum. of Appeal herein on Thursday, March 27, 2025, an interim Order is hereby issued staying the execution/enforcement/operation of the decision of the Respondent dated March 18, 2025 (NTSA/C/RT/010/2VOL. (1)), suspending the operations of the appellant herein, SUPERMETRO Sacco Limited as a PSV Operator,” Kamotho ordered.
“The appellant is at liberty to immediately resume operations in due compliance with the law.”
The board also directed the order be served to the Inspector General of the National Police Service immediately, ensuring that enforcement officers are aware of the decision and that Supermetro Sacco’s operators can carry on with their work without further legal obstacles.
Supermetro Sacco’s operations had been halted on March 18, 2025, when NTSA suspended its fleet due to regulatory concerns.
This disruption left thousands of commuters without a crucial mode of transport.
However, after filing an urgent appeal, Supermetro Sacco was granted an interim order by the Appeals Board on March 24, 2025.
The ruling ensures that the Sacco can now operate its fleet while the appeal is heard and determined.
The case arose after NTSA suspended Supermetro Sacco’s operations on March 18, 2025, citing regulatory concerns.
The decision had left the Sacco’s fleet grounded, causing a disruption for many passengers dependent on its buses.
However, after Supermetro Sacco filed an urgent appeal, the Transport Licensing Appeals Board led by its chairman Adrian Kamotho issued an interim order on March 24, 2025, allowing the Sacco to resume services while the appeal process continues.
In its ruling, the Board acknowledged the urgency of the situation, certifying Supermetro Sacco’s application as an urgent matter that required immediate attention.
The ruling effectively stayed the suspension imposed by NTSA, permitting the Sacco to return to the roads while the case is heard in full.
This temporary relief ensures that Supermetro Sacco’s buses can operate without interruption, alleviating the burden on commuters who depend on the Sacco for their daily transportation needs.
The Appeals Board also set a schedule for the legal suit moving forward.
NTSA has been ordered to file its response to the appeal by March 25, 2025, while Supermetro Sacco is allowed to submit any supplementary documents by March 26, 2025.
A full hearing for the case has been scheduled for March 27, 2025, at 2:30 PM.
The temporary stay of NTSA’s suspension means that Supermetro Sacco can continue operating in full compliance with the law, pending the final outcome of the case.
