High Court Blocks Deputy Governor’s Gazettement, Grants Reprieve to Kawira Mwangaza

Meru Governor Kawira Mwangaza has received a lifeline from the High Court after it issued conservatory orders staying the implementation of the Senate’s resolution to remove her from office.

The court, presided over by Judge Bahati Mwamuye, also barred the Speaker of the Senate from declaring the governor’s seat vacant, pending the hearing and determination of the case.

The court’s orders specifically stay the furtherance or implementation of the Senate’s resolution to impeach Governor Mwangaza. This effectively stops any action toward her removal from office until the matter is fully heard and determined by the court.

Additionally, the court issued a restraining order against the Speaker of the Senate, preventing the publication or declaration of a vacancy in the Office of the Governor of Meru County in the Kenya Gazette.

This move ensures that the governor’s office remains occupied by Mwangaza until the legal challenges surrounding her impeachment are resolved.

Governor Mwangaza, who has been at the center of a political storm in Meru County, had been impeached on grounds of gross misconduct, allegations she has strongly denied.

The High Court’s intervention now places the entire process on hold, offering her a crucial window to contest the Senate’s decision.

The ruling by Judge Mwamuye is seen as a significant legal development in the ongoing saga, highlighting the judiciary’s role in safeguarding the rights of elected officials and ensuring that all procedures are followed correctly in cases of impeachment.

The case is expected to draw considerable attention as it progresses, with implications for the balance of power between the county government and the national legislative bodies.
