DPP’s Attempt to Withdraw Sh 300 Million Land Case Opposed by Complainant

An attempt by the Director of Public Prosecutions (DPP) to withdraw a land fraud case valued at Sh300 million was rejected by the complainant.

The DPP, through an application filed under Section 87(a) of the Criminal Procedure Code, sought to terminate the case against Abdirahman Muhumed Abdi.

However, the complainant, through his lawyer, strongly objected, arguing that no valid reasons had been provided for the withdrawal.

Appearing before trial magistrate Geoffrey Onsarigo, the complainant’s counsel told the court that the matter had already been scheduled for hearing and that the complainant was present in court and ready to testify.

The court was further informed that any attempt to withdraw such a serious matter required that all parties be notified in writing.

In the case, Muhumed is charged with forgery and making a false document with the intent to defraud Pansiba Limited of two parcels of land, LR No. 209/10848 and LR No. 209/10849, measuring approximately 0.8 hectares and collectively valued at Sh300 million.

It is alleged that he fraudulently amalgamated the two parcels into LR No. 209/16790 and forged a certificate of title purporting it to be a genuine document issued by the Ministry of Lands and Physical Planning.

In the final count, Muhumed faces an additional charge of making a false document.

Following a report to the Directorate of Criminal Investigations (DCI), an investigation was launched. Statements were recorded from six prosecution witnesses, who have since completed pre-trial procedures and are ready to testify.

The court is set to deliver a ruling on August 8, 2025, on whether the DPP’s application to withdraw the case will be allowed.
