A city lawyer alleged to have forged a trust deed in the name of a company in order to obtain Sh 59 Million from a deceased person has been ordered to take a plea next week.
This is after the Court was told lawyer Lawyer Nelson Ndalila is indisposed and is on a five day bed rest.
Ndalila was to appear before Milian Senior Principal Magistrate Dolphina Alego to plead to four counts of forgery.
However, the suspect, through his lawyer, requested the Magistrate to differ the plea against him as he was given 5 days by his doctor to rest after falling sick.
“Your honour, my client is sick and was given bed rest. We request to have the plea deferred to May 6 when he can appear before your to plead to the charges”, the court was told.
The prosecution requested for medical documents to ascertain that the suspect is indeed sick.
The court allowed the application and deferred the plea to Tuesday, May 5, 2025.
According to the charge sheet tabled in court, Ndalila is charged that with others not before court, he forged a Trust Deed in the name of better life family trust dated June 2, 2023 for the purpose of obtaining a financial benefit of Sh 59 Million from the estate of the late David Jonathan Grantham.
He is alleged to have committed the offence on June 2, 2023, at an unknown place in the country.
He faces three other charges of making and uttering false documents.
Ndalila who is out on Police Cash bail of Sh50,000, will appear in court tomorrow to answer to the charges.
The prosecution has listed three witnesses to testify in the case.
