In a dramatic session on Monday, January 13, 2025, High Court Judge Chacha Mwita issued a stern warning to top security officials, including Inspector General of Police Douglas Kanja and DCI boss Amin Mohamed, after they failed to attend court proceedings concerning the abductions of three men in Mlolongo last December.
Justice Mwita expressed deep frustration over their defiance of court orders, declaring that the failure to attend court was a serious breach, warning that the full force of the law will soon come crashing down on them.
Justice Mwita, visibly disturbed, addressed the continued disobedience by Inspector General of Police Kanja, and DCI boss Mohamed, who both failed to appear in court to explain the mysterious disappearance of three individuals abducted in Mlolongo last December.
“The court must state clearly that the IG and DCI have a duty to the people of Kenya in protecting their lives and property,” Justice Mwita said, his tone firm.
“Failure to attend court over such an issue is a serious breach of court orders which calls for sanctions. The court will respond to the cries of the petitioners without hesitation.”
The missing individuals Justus Mutumwa, Martin Mwau, and Karani Mwema were allegedly abducted in Mlolongo, and their families have been desperately seeking answers.
The judge emphasized the gravity of the case, noting the IG and DCI’s continued defiance of the law.
“This is a grave omission by state officers who have an obligation to respect, uphold, and defend the constitution,” Justice Mwita remarked.
The court’s patience is running thin, with the judge giving a final ultimatum to the IG and DCI.
“I direct the IG and DCI to release the three petitioners immediately and unconditionally or bring their bodies before this court,” Justice Mwita ordered.
“Alternatively, present their bodies by January 17, 2025, at 10 am.”
The court also addressed the absence of the Interior Cabinet Secretary, Kipchumba Murkomen, and Attorney General Dorcas Oduor, questioning why they failed to attend despite being served with orders.
The lawyers representing the families of the missing men Polycarp Okello and Nyawa Malidzo petitioned the court to cite both security chiefs for contempt, a call that was strongly supported by Justice Mwita.
The judge’s orders came after a dramatic failure by the DPP’s office to provide any information on the whereabouts of IG Kanja or DCI Mohamed.
The DPP’s lawyer even attempted to have his office removed from the case, stating it had no role in abduction matters.
However, the court rejected this request, demanding the DPP respond to the case and continue to be part of the proceedings.
In a final dramatic twist, Justice Mwita removed the name of Steven Mbisi Kavingo from the petition, after the court was informed he had a similar case pending before another court scheduled for January 27, 2025.
