AG Seeks Time to Verify President’s Statement on Police Officer Kabiru’s Death

The Attorney General has asked the High Court for more time to verify a statement issued by President William Ruto in New York confirming the death of police officer Benedict Kabiru, who was serving in Haiti.

On Wednesday, Justice Chacha Mwita allowed the adjournment of a petition filed by Kabiru’s family seeking his production, after the State Law Office said it needed to confirm the President’s remarks.

Lawyers Mbuthia Gathinji and Muturi Njoroge, representing the family, told the court:“We have downloaded the statement from the presidential website pronouncing that Kabiru had passed on.”

The lawyers added that if the Attorney General’s office verified the statement, the constitutional petition would no longer be necessary.

Appearing for the AG, State Counsel Betty Musau requested seven days to confirm the authenticity of the statement and file a replying affidavit.

“We are seeking time to confirm the statement attributed to the President,” she told the court.

Justice Mwita directed that the case be mentioned on October 8, 2025, to confirm the next course of action.

Outside the Milimani Law Courts, the family’s lawyers expressed frustration, noting that six months had passed since Kabiru’s death on March 26, 2025, yet his family had not been officially informed.

“Kabiru passed on six months ago, and the family has not been told anything,” they said.

They further explained that Kabiru died alongside two other Kenyan police officers who were serving in a peacekeeping mission in Haiti.

They added that even Haiti’s transitional President had confirmed the tragedy.

“The transitional President of Haiti has already confirmed that Kabiru died while on duty,” the lawyers told reporters.

The matter will resume in October, pending verification by the Attorney General’s office.
