A postmortem examination has confirmed that Cheryl Adhiambo, a 21-year-old Kenya Medical Training College student, died from a single gunshot wound to the head during a police operation in Huruma estate on February 7.

Pathologists Grace Midigo and Simon Omuok, who conducted the examination, determined that the bullet entered through the left side of Adhiambo’s head and exited from the back, rupturing the cerebral cavity.

The medical experts stated unequivocally that the injuries were fatal and incompatible with survival.

The findings have intensified demands for accountability from activists and political leaders, who are calling for justice following allegations that Adhiambo was shot by police during an operation targeting suspected robbers.

The Independent Policing Oversight Authority has deployed a Rapid Response Team to investigate the circumstances surrounding her death.

The team is currently gathering evidence, interviewing witnesses, and analyzing exhibits related to the incident.

According to the National Police Service, the operation began after a complainant reported being robbed of a silver chain and 1,800 shillings by five young men.

Officers arrested two suspects initially, then moved to arrest two additional suspects that evening.

Police say that during the second arrest, one suspect raised an alarm, prompting nearby youths to stone officers.

The NPS maintains that officers fired warning shots into the air to disperse the crowd, during which Adhiambo was fatally shot.

The incident has sparked unrest in Huruma, with authorities urging residents to allow the investigation to proceed and refrain from further violence as tensions remain high.

The Law Society of Kenya (LSK) has issued a strong condemnation following an incident in which police officers lobbed teargas at worshippers during a church service in Othaya, Nyeri County.

In a statement released on Sunday, the LSK said it was “deeply concerned by images of Police officers lobbing teargas at congregants taking part in a church service in Othaya,” describing the incident as a grave abuse of state power.

The lawyers’ body faulted the National Police Service (NPS) for what it termed an unjustified and excessive use of force against civilians, including children.

“The indiscriminate use of violent force against church-going citizens, including children, offends every constitutional principle under which the National Police Service is bound to operate,” the statement read.

LSK said the police action amounted to a direct assault on multiple constitutional rights.

“This onslaught on the right to religion, freedom of association, human dignity, freedom and security of the person and the right of children to be protected from all forms of violence is detestable,” the Society added.

Footage circulating online showed panicked worshippers fleeing the church compound as teargas engulfed the area, disrupting the service and raising concerns about the safety of civilians in places of worship.

The Society further warned that such incidents risk eroding public trust in state institutions at a sensitive political moment.

“We condemn this incident, which betrays the Kenyan people’s collective call for an end to police brutality and indiscipline,” LSK said

“There was no ascertainable threat posed by church congregants against peace, law and order to warrant such a brazen attack.”

According to the lawyers’ body, the incident poses “a damning threat of undermining tolerance and cohesion as we approach another high-stakes electioneering period.”

LSK has now demanded accountability from the police leadership.

“We call upon the National Police Service to issue an immediate, clear explanation of the circumstances leading up to the abhorrent events in Othaya, and a full report on the actions it intends to take against the perpetrators,” the statement said.

The Society also announced it is mobilising legal support for affected members of the public.

“We will be coordinating with our advocates on the ground to understand the full extent of violations that occurred, and establish whether there are any members of the public in need of legal support following the incident,” it added.

As of publication, the National Police Service had not issued a detailed public response explaining the deployment of teargas at the church.

Four years after the tragic deaths of Boniface Njiru (22) and Emmanuel Mutura (19), their case continues to unravel in Milimani High Court, where six police officers face charges of murder.

The trial resumed on Monday, bringing chilling eyewitness testimony that paints a grim picture of alleged police brutality on the night of August 1, 2021.

Newton Kinyua, a security guard at Namuru Bar, told Justice Margaret Muigai that he witnessed the brothers being violently assaulted before being loaded into a police Landrover.

“Boniface and Mutura were with four others when they came out of Namuru Bar and Restaurant around 10 pm. They ran in different directions when they saw the police vehicle, as it was during the Covid-19 curfew. A police officer with a long stick jumped from the vehicle and attacked Boniface,”
Kinyua recounted.

He described how Boniface was struck repeatedly until he fell unconscious, after which another officer set upon Mutura with punches and kicks.

Kinyua, who had taken cover in a public toilet, said he could see everything clearly under the electric lights.

“The two officers picked Boniface from the ground and loaded him into the Landrover. They also helped Mutura to his feet and assisted him into the vehicle. I saw it speed off towards Kianjakoma Hospital. I noticed the vehicle leave the hospital after some time,”
he testified.

Kinyua told the court that both brothers were his friends and ran a butchery business at Kianjakoma.

He learned the following day that they had died.

During cross-examination, defense lawyers Martina Swiga and Danstan Omari questioned Kinyua’s ability to identify the officers or confirm the deaths.

“I did not see the police kill the two brothers, nor did I see them jump from the moving vehicle,”
Kinyua admitted.

The six accused, James Mwaniki Njogu, Benson Mbuthia, Consolata Kariuki, Nicholas Cheruiyot, Martin Wanyama, and Lilian Cherono, have consistently denied murdering the brothers while enforcing Covid-19 curfew rules.

Their plea was entered on August 17, 2021, and the case was later inherited by Justice Muigai following the demise of Justice Daniel Ogembo.

Prosecution testimony states that police were patrolling to enforce curfew regulations when they encountered the brothers, who were walking home after closing their business.

Reports indicate that some bars in Muchagori, Embu, were operating beyond the stipulated curfew.

The mother of the deceased testified that she had called her sons to close their business and return home early, but instead, she learned that they had been killed by police.

The incident sparked public outrage in Embu County, leading to demonstrations that resulted in the burning of a police vehicle.

The defense challenged the credibility of Kinyua’s account, arguing that the incident occurred at night, during rain, making it impossible for him to clearly see or follow the police vehicle.

“The witness is relying on what he heard and saw from a distance. It is not clear whether the brothers died in the vehicle or jumped from it,” defense lawyers submitted.

Justice Muigai directed that the trial would continue with further witness testimony on February 12 and 19, 2026, with the next hearing scheduled for February 5, 2026.

The High Court has refused to issue conservatory orders preventing Deputy Inspector-General (DIG) Eliud Kipkoech Lagat from resuming his duties while a constitutional petition filed by UK-based activist Eliud Matindi is pending.

Justice Chacha Mwita directed Lagat, the Attorney General Dorcas Oduor, and the National Police Service Commission (NPSC) to file their responses to the petition by July 23, 2025, after which the court will give further directions.

Matindi had requested interim orders to bar Lagat from performing any functions as DIG, citing Section 23 of the National Police Service Act.

He also sought similar orders against Lagat’s assistant, Patrick Tito, who was allegedly irregularly appointed as acting DIG through a delegation letter dated June 16, 2025.

Represented by lawyer Cecil Miller, Lagat asked for more time to respond before any injunctive relief could be issued.

The AG and NPSC also requested 14 days to file their responses.

Despite the Attorney General’s claim of not being served, Justice Mwita dismissed this, noting that substituted service had been effected through a newspaper advertisement published on July 4, 2025.

Matindi argued that Lagat’s “step aside” from office following the death of blogger Albert Ojwang’ in police custody was unconstitutional, pointing out no legal provision allows a DIG to self-step aside under Kenyan law.

He asserted a transparent recruitment process should have been initiated instead.

Highlighting the ongoing crisis in the Kenya Police Service, Matindi urged the court to act urgently to protect constitutional order and public interest.

Justice Mwita ordered all parties, including the Law Society of Kenya and Katiba Institute, to submit their responses within seven days.
