Justice Margaret Muigai cited risks of witness interference, threats to the victim’s family, and potential erosion of public confidence in the justice system as reasons for denying the application.

“The court finds the reasons advanced by the DPP on the possibility of interference with witnesses, protection and safety of victims, and maintenance of public order, peace and security, to be compelling,” Justice Muigai ruled.

Baraza had told the court he would comply with any bail conditions.

“I will not abscond, and will attend all proceedings whenever and wherever required,” he said, noting his residence in Kayole.

The prosecution, however, argued that his police training and access to investigative networks made him a flight risk and could allow him to intimidate witnesses.

An affidavit filed in court noted that several witnesses, including junior officers and civilians, fear for their safety.

“The applicant is well trained and conversant with investigative procedures, police networks, and knowledge to evade detection. He may interfere with witnesses and tamper with evidence,” Justice Muigai observed.

The court also highlighted the suffering of Kariuki’s family, who have faced intimidation since the incident.

“The family of the deceased have had their phones jammed with calls and SMS messages castigating them… they fear possible interference with witnesses and the hearing process,” the judge noted.

Justice Muigai said Baraza could renew his bail application after key witnesses have testified and urged the trial court to expedite proceedings.

The case will be mentioned again on February 17, 2026, to fix hearing dates.

The veteran officer was arrested Saturday at Holo Police Station in what investigators describe as a brazen display of criminal audacity, allegedly relaxing and enjoying proceeds from a string of violent robberies that have terrorized residents for months.

Owino’s downfall began with a robbery in Ajigo, Siaya County, that captured public attention after images and videos from the incident spread rapidly across social media platforms.

The footage, which showed armed assailants terrorizing victims in broad daylight, inadvertently captured clear images of one of the perpetrators.

Within hours, eagle-eyed members of the public began circulating the images, and the identification came swiftly, the man in the footage was none other than Officer Owino, a serving police officer known in local circles as “Owis.”

“The public response was overwhelming,” said a police source who requested anonymity.

“People recognized him almost immediately. Some had encountered him in his official capacity; others knew him from the neighborhood. The digital footprint was undeniable.”

According to preliminary investigations, the Ajigo incident was not isolated. Detectives have now linked Owino to a series of violent robberies spanning several months across Siaya County and neighboring regions.

The detention order was granted by the Chief Magistrate Dolphina Alego of  Milimani Law Courts following an application by the Director of Public Prosecutions (DPP) under Article 49(1) of the Constitution, as well as sections 123, 123A, and 118 of the Criminal Procedure Code.

The prosecution argued that the suspect posed a high risk of absconding due to having no fixed residence, no family, and no mobile phone.

In an affidavit filed in court, CPL Antony Kerini, attached to DCI Nairobi Central  that the suspect who is a street boy is being investigated for the offences of Murder and opposed his release on bail.

“The respondent has no known fixed place of abode, no known family members or contact persons, and does not own or use a mobile phone. There exists a high risk of absconding should the suspect be released on bail.”

The suspect is accused of killing Muriuki on August 15, 2025, around 2:00 am, while the deceased was walking with Mercy Wanjiku Wambui from Tsunami Market near Ngara area towards Nairobi CBD.

According to the prosecution, the suspect, joined by others still at large, hit the deceased with a sharp object on the head, leading to his death.

The prosecution further told the court that the suspect has voluntarily agreed to cooperate with investigators.

“I am able and willing to lead the police to my co-suspects who are currently in hiding, and to help recover the murder weapon.”

The DCI detectives told court that releasing him at this stage could compromise ongoing investigations, interfere with witnesses, and obstruct the recovery of the murder weapon.

The co-suspects are reportedly hiding in Isiolo and Nanyuki, and their arrest is considered crucial to completing the probe.

The court granted the 21-day detention, emphasizing the need to balance the interests of justice and public safety.

The magistrate ordered Kamande to be held at Central Police Station pending further investigations.

In a statement issued on Wednesday, the DCI identified the suspect as Wycliffe Otieno Odero, who is wanted in connection with what detectives have described as “one of the most disturbing domestic murder cases in recent months.”

“We are appealing to members of the public to provide any information that may lead to the arrest of 28-year-old Wycliffe Otieno Odero, whose photograph appears below,” the DCI said.

“The suspect is wanted for the brutal murder of his wife and two children in Yare area of Samburu Central Sub-County.”

According to investigators, the suspect, who worked as a casual labourer in Maralal town, lived with his wife, Ann Njeri Atheera, and their two daughters, Natalia Nyambura (6) and Tyra Jones (4), in a rented house along the Maralal–Nyahururu road.

Preliminary findings indicate that on the fateful night, Odero arrived home visibly drunk and engaged in a heated argument with his wife over an undisclosed domestic issue.

“In a fit of rage, the suspect is believed to have attacked his wife with a kitchen knife, inflicting multiple stab wounds that led to her death,” a detective attached to the DCI Maralal office told reporters.

“He then turned the weapon on his two daughters, who were asleep, and slit their throats before fleeing into the night.”

Neighbours who heard commotion inside the house said they initially thought it was a minor quarrel.

“We heard shouting and crying, but it stopped suddenly,” said a neighbour, Mary Lekishon.

“When we went to check in the morning, the door was locked from outside. That’s when we suspected something terrible had happened.”

Police officers who responded to the scene were met with a gruesome sight.

The bodies of the woman and her children lay in pools of blood on the bedroom floor.

“It was a heartbreaking scene,” said Samburu Central Sub-County Police Commander, Peter Mwangi.

“Even our most experienced officers were deeply shaken. No child deserves to die in such a brutal manner.”

A manhunt was immediately launched, but Odero managed to evade capture. Detectives have since extended the search to neighbouring counties, including Laikipia, Baringo, and Nakuru, amid fears that the suspect might have sought refuge with relatives or friends.

The DCI has circulated Odero’s photograph and urged anyone with information regarding his whereabouts to report immediately to the nearest police station.

“Members of the public are warned that the suspect is dangerous and may be armed,” the agency cautioned. “Do not attempt to apprehend him yourself. Instead, alert law enforcement authorities immediately.”

The killings have sparked outrage and sorrow across the region, with leaders and residents condemning the rise in domestic-related violence.
