										<content:encoded><![CDATA[<p>Broadway Bakery Limited has sued rival bread maker DFL Festive Limited at the Milimani High Court, accusing the company of running a disparaging and misleading advertising campaign targeting its brand, products, and packaging.</p>
<p>The commercial suit, filed on June 11, 2025, and listed under the court&#8217;s Commercial Division, names DFL Festive as the defendant and seeks sweeping remedies including injunctions, a mandatory retraction order, and damages.</p>
<p>According to court documents, Broadway Bakery is asking the court for a declaration that the commercial advertisement on social and print media contained in a specific video online amounts to disparaging and misleading advertisement.</p>
<p>The plaintiff wants the Advertising Standards Body of Kenya to hear and determine its complaint, which it filed before the regulatory body on December 13, 2024, and is asking the High Court to direct that process to be handled expeditiously, efficient, and within the timelines that this Honourable Court shall deem fit and just, in accordance with the provisions of Article 47 of the Constitution, as read together with the Fair Administrative Actions Act, Cap 7L Laws of Kenya.</p>
<p>Broadway Bakery is also seeking a mandatory court order compelling DFL Festive to fully retract, delete or pull down the test and tenor of the video from the internet, including from all search engines such as Google, Bing, DuckDuckGo, Yahoo and any other search engines where the disparaging and misleading advertisement may have been published.</p>
<p>At the heart of the dispute appears to be the use of the orange colour on wax paper bread packaging and the use of the word heritage when describing bread, details Broadway Bakery says belong to its brand identity.</p>
<p>The plaintiff is seeking a permanent injunction restraining DFL Festive from publishing and/or causing to be published or reposting any publication making reference to the orange colour for the wax paper packaging of bread and use of the word &#8216;heritage&#8217; when describing the bread across YouTube, Facebook, WhatsApp, Telegram, Instagram, TikTok, X, and any other social media platforms.</p>
<p>A separate permanent injunction is also being sought against Royal Media Services or any other print media from publishing or causing to be published the contested video.</p>
<p>Broadway Bakery is asking the court to award special damages, general damages for publication of disparaging and misleading advertisement against the Plaintiff,as well as exemplary and aggravated damages.</p>
<p>It is also seeking interest on those damages at Court rates from the date of Judgment until payment in full,plus costs of the suit.</p>
<p>The lawsuit comes against a backdrop of public intrigue surrounding the two companies.</p>
<p>Last year, eagle-eyed consumers flagged that both Broadway Bakery and DFL Festive&#8217;s packaging carried identical contact details, a coincidence that sparked widespread speculation on social media about whether the two rival bread brands were, in fact, related or under common ownership.</p>
<p>Neither company publicly addressed those claims at the time.</p>
<p>The matter is still ongoing before the Milimani High Court&#8217;s Commercial Division.</p>

										<content:encoded><![CDATA[<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">A High Court advocate has testified how former Lamu Senator Anwar Loitiptip allegedly orchestrated the sale of a luxury vehicle using what turned out to be a forged logbook, a Milimani court heard on Tuesday.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">Maina, an advocate who previously worked at Loitiptip&#8217;s Kilimani office, took the stand as the prosecution&#8217;s first witness, detailing his role in facilitating a transaction that police later flagged as fraudulent.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">In testimony before Senior Principal Magistrate Paul Mutai on February 10, 2026, Lawyer Maina recounted how the former senator called him on August 3, 2022, with specific instructions to prepare sale agreements for a Toyota Land Cruiser registered as KDA 005C.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">&#8220;He told me he wanted to sell his vehicle and asked me to originate the sale agreements and share them on WhatsApp so that they could be forwarded to the buyer,&#8221; Maina told the court.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">The advocate said Loitiptip then directed him to a house in Kileleshwa, where he found the senator already present with the buyer, Samson Mutina Malonza, and another unidentified individual.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">Maina testified that he acted for both parties in the transaction, witnessing the exchange of cash amounting to Sh3 million, half of the agreed Sh6 million purchase price, which was handed directly to Loitiptip.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">&#8220;The balance was to be paid the same day and that is when the vehicle would be released,&#8221; he said.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">Central to the case was a motor vehicle registration certificate bearing serial number K4250950P, which was presented during the transaction and indicated Loitiptip as the registered owner.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">The logbook showed it had been issued on August 25, 2017.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">However, Maina&#8217;s involvement took a dramatic turn when he received a call from a police officer asking him to report to Kilimani Police Station.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">&#8220;I was informed that the logbook that had been issued was a fake logbook,&#8221; he testified.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">A second advocate, Daniel Muliro, testified that he had acted for Ramna International Motors, the dealership that originally sold the same vehicle to Loitiptip under a hire purchase agreement in August 2020 for Sh10 million.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">Muliro told the court that Loitiptip paid only Sh3.5 million as deposit before allegedly disappearing, leaving a balance of Sh6.5 million unpaid.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">&#8220;That transfer was impossible because technically the company was still the owner of the vehicle since the full purchase price had not been paid,&#8221; Muliro said, explaining that an NTSA search still reflected Ramna International Motors as the registered owner even after a logbook was issued in Loitiptip&#8217;s name on October 9, 2020.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">The defence challenged both witnesses, arguing their testimony was based on instructions and information from third parties.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">Loitiptip, who served as Lamu Senator from 2017 to 2022, faces two counts: making a false motor vehicle registration certificate and fraudulently uttering a forged document to the buyer, both allegedly committed on August 3, 2022.</p>
<p class="font-claude-response-body break-words whitespace-normal leading-[1.7]">The case will be mentioned for further hearing on March 26, 2026.</p>

										<content:encoded><![CDATA[<p>‎Kibera MP Peter Orero’s driver, George Oduor, has been sentenced to one year in prison or pay an alternative fine of 100,000 for dangerous driving.</p>
<p>Appearing before Milimani law courts trial magistrate Rose Ndombi, Odour admitted the traffic charges levelled against him.</p>
<p>According to the charge sheet on the 9th day of October 2025at about 1440hrs along oloitoktok road within Nairobi county, being the driver of a motor vehicle registration number KBN 546s make Toyota Prado dangerously overtook the flow other motor vehicles.</p>
<p>‎In mitigation, Oduor asked the court for leniency, saying he was rushing to the airport and did not intend to break the law.</p>
<p>He also stated that he has not committed that offence before or arraigned in court of law, saying he is a first-time offender.</p>
<p>The prosecution told the court that they were unable to get the video recorded by CNN International correspondent Larry Madowobut admitted to having watched the video.</p>
<p>The court was also told that odour was arrogant and apologetic in the clip.</p>
<p>The magistrate ina short ruling ordered Oduor to pay a fine of 100,000 or one year in prison.</p>
<p>&#8220;Having considered the mitigation by the accused person found and held that the section under which he has been charged attracts a fine of sh 100,000 or 1 year imprisonment.&#8221; Ruled the magistrate.</p>
