Equity Bank Group CEO James Mwangi and his wife have suffered a major setback in their fight to retain a Sh1 billion property at Muthaiga after the Court of Appeal declined to halt a judgment that found they illegally acquired the prime land.

The appellate court has instead ordered the couple to deposit Sh10 million as security while maintaining the status quo on the 3.733-acre disputed property even as police have already handed it over to its rightful owner, Mount Pleasant Limited.
.
The Court of Appeal, comprising Judges Daniel Musinga (President), Pauline Otieno Kiage, and Olive Muchelule issued the order on February 4, 2026, following an application by the Mwangi and his wife Jane Wangui Mwangi seeking to halt the execution of the Environment and Land Court judgment that ordered them to vacate the land after finding that they had unlawfully acquired the multi-billion prime land pending the hearing and determination of their appeal in the Sh1 billion land dispute.

“The status quo with regard to the suit property shall be maintained pending hearing and determination of the appeal, which we direct that it be expedited,” the Musinga led bench ruled.

“The applicant shall deposit a sum of Sh10 Million in an interest earning account in the joint names of counsel for the appellant(Mwangi) and the 1st respondent(Mount Pleasant Limited) within sixty (60) days from today.”

The orders came after the property had already been handed over to Mount Pleasant Limited.

According to a police report dated January 7, 2026, from Gigiri Police Station, the Environment and Land Court order to the couple vacate the property had been executed under supervision of the Officer Commanding Station (OCS) Gigiri, with Mount Pleasant Ltd gaining possession of the property.

“The above court order has been executed today the 07/01/2026 under supervision of the OCS Gigiri and now the plaintiff Mount Pleasant Ltd has now gained possession of the property,” stated Officer Commanding Police Station Jennifer Mutuku in the official police document.

Mwangi’s appeal follows a landmark judgment by Environment and Land Court Judge Oscar Angote delivered on October 23, 2025, which found that Mwangi and his wife had no legal claim to the prime Muthaiga property and had unlawfully taken possession of land belonging to Mount Pleasant Limited.

In his detailed 150-page ruling, Justice Angote found glaring irregularities in the documents presented by the couple, including missing volume references, unsigned land registry entries, and inconsistencies in file numbers, which rendered their alleged 2012 purchase from the late President Daniel arap Moi null and void.

Justice Angote declared that the land, originally registered as L.R 214/20/1/1 and L.R 214/20/2, and later irregularly amalgamated into L.R 214/832, belongs to a private company Mount Pleasant Limited, not Dr. Mwangi and his wife.

The judge ordered the couple to pay Sh10 million in general damages for trespass, with interest accruing from the date of judgment until full payment, and to vacate the property immediately under threat of police enforcement.

“An award does hereby issue of general damages for trespass, assessed at Sh 10 Million. The 1st and 2nd Defendants (Mwangi and his wife Wangui) to pay interest on the above amount at court rates from the date of this Judgment until payment in full. The 1st and 2nd Defendants’ counterclaim is dismissed with costs. The 1st and 2nd Defendants to pay the Plaintiff the costs of the suit,” Justice Angote ruled.

The decision restored ownership of the 3.733-acre property to Mount Pleasant Ltd, which traced its acquisition back to former Cabinet Minister Arthur Kinyanjui Magugu and his wife, Margaret.

According to company records, Mount Pleasant purchased the property in 2006 for Sh 130 million after the Magugus redeemed it from the National Bank of Kenya.

Dr. Mwangi, however, insisted that he legally purchased the same land in 2012 directly from the late President Moi for Sh320 million, presenting a conveyance allegedly executed by the former Head of State.

Mwangi claimed he had taken possession of the land and initiated amalgamation and survey approvals to consolidate the parcels.

But Justice Angote concluded that President Moi had lost ownership of the parcels back in 1982 when he transferred them to the Magugus, whose title was subsequently conveyed to Mount Pleasant Ltd.

“Any subsequent transaction purporting to return the property to Moi or to sell it again is null and void,” the ruling states.

The judgment highlighted glaring irregularities in the documents produced by Dr. Mwangi, including missing volume references, unsigned land-registry entries, and inconsistent file numbers, which the court found rendered the alleged 2013 conveyance invalid.

The court observed that any attempt to reassign the property to Mwangi and his wife after it had been legally transferred to the Magugus in 1982, and subsequently to Mount Pleasant Limited, was invalid.

Consequently, the Chief Land Registrar and the National Land Commission were directed to expunge Mwangi’s title and restore the original ownership to Mount Pleasant Ltd.

Justice Angote further issued a permanent injunction barring the defendants, or their agents, from accessing or dealing with the property and ordered immediate vacation of the premises. Police assistance was authorized to enforce the eviction if necessary.

The court also awarded Mount Pleasant Ltd in profits of Sh500,000 per month from the date of unlawful occupation.

The case had been filed in 2020 by Mount Pleasant Ltd’s director, Anverali Mohamed Karmeli Amershi, against Equity CEO Mwangi, his wife, and others.

In his testimony before court, Amershi recounted how the company purchased the land from the Magugus, who had redeemed it from the National Bank of Kenya following a mortgage default.

“Our purchase price was Sh130 million. We took possession in 2006 and have been in continuous occupation since then,” Amershi testified.

“The defendants claim to have bought the land in 2012, but they never produced valid documentation to support that.”

Amershi described repeated attempts by the Mwangi family to assert ownership, including alleged evictions of the company’s security personnel.

“This is not just about ownership; it’s about trespass and the unlawful takeover of property that does not belong to them,” he said.

Equity CEO Mwangi recounted his version of events in court, stating that he had purchased the property from the late President Moi in December 2012 and had paid a deposit of Sh32,060,000, with the balance of Sh200,000,000 completed thereafter.

He claimed that the former President personally “blessed” the sale at his Kabarnet Gardens residence.

“I conducted a search, verified all details, and completed a valuation before executing the agreement. By April 2013, the sale was complete,” Dr. Mwangi testified.

“We took possession, engaged security, and even constructed a boundary wall.”

However, the court noted that Mwangi failed to produce critical supporting documents, such as the alleged sale agreement with President Moi and evidence of payments for amalgamation and survey approvals.

The detailed judgment meticulously traced the ownership history of the parcels.Originally allocated to James Archibald Morrison during the colonial era, the land changed hands multiple times, ultimately being conveyed to the late President Moi by the 8th Duke of Portland’s estate in 1980.

Moi mortgaged the land to Standard Bank, which reconveyed it back to him in 1982 before selling it to the Magugus.

Mount Pleasant Ltd legally acquired the land from the Magugus in 2006, registering the transfer and paying all requisite stamp duties.

The company also applied for amalgamation of the two parcels and undertook sub-division approvals in compliance with Nairobi County regulations.

The Court of Appeal judges have listed Mwangi’s appeal for a case management conference within 30 days by which time the parties are expected to have filed their respective submissions, as well as their lists and bundles of authorities.

The Environment and Land Court in Nairobi has declined to stop Mandera Governor Mohamed Adan Khalif from proceeding with the construction of residential flats on land that North Highridge Primary School claims it owns in Parklands.

The ruling comes after the school’s Board of Management sought a temporary injunction to halt the development of a multi‑storey apartment complex on Sixth Avenue while the ownership dispute is fully determined by the court.

In her ruling, Justice Christine Ochieng explained that the school had not met the legal threshold for interim relief.

“Looking at the documents the plaintiffs have presented, I note they provided a history of the disputed land but failed to file any documents to support their claim on the suit land,” Justice Ochieng said.

She added that:“Allegations of forgery and illegality in the governor’s title could only be properly examined during a full trial, not through an interim injunction.”

The judge noted that relevant government authorities, including the National Construction Authority (NCA), had confirmed compliance with development regulations.

“Since the first defendant (Mohamed Adan Khalif) was granted development permission for his land, with the relevant government entities acknowledging this position, I am unable to restrain him from his property,” the judge held.

The contested project is a 10‑storey residential development planned to deliver 160 housing units on a parcel the school insists forms part of its original compound.

According to the school’s petition, the land was part of its 2.2‑hectare plot set aside for educational purposes but was “systematically reduced through irregular surveys, excisions and re‑registrations.”

School officials allege that the property’s title was eventually re‑registered to the governor, whom they claim lawfully acquired the parcel in 2021 for about Sh140 million.

The Board also raised concerns about the impact of the construction on the learning environment, highlighting that:“Classrooms now sit only metres from the rising structure,” and parents have argued that the development poses safety risks and worsened congestion at a school hosting classes from ECDE to secondary level.

The Environment and Land Court in Kilifi County has ordered a temporary suspension of all construction of affordable housing at Watamu Public Park, following a petition filed by environmental activist Halima Lali Mohamed.

The decision has been hailed by conservationists as a “Christmas gift” for the preservation of one of the coastal town’s last public green spaces.

The petition challenges the development, citing violations of environmental regulations by the Attorney General, the National Environment Management Authority (NEMA), the Ministry of Lands and Housing, the Affordable Housing Board, and the Kilifi County Government.

According to Mohamed, the project threatens the park’s ecological integrity, and she strongly condemned the cutting of trees at Watamu Park to create space for the affordable housing project, calling it a serious threat to the environment and the town’s natural heritage.

Presiding over the case, Justice Mwangi Njoroge certified the matter as urgent and issued interim orders to maintain the status quo at plot number 70, Watamu.

“In the interim and having regard to the provisions of Article 70(1) (2) and (3) and the requirement of precautionary principle under section 3(5) (f) of the Environmental Management and Co-Ordination Act CAP 387, it is hereby ordered that the status quo of plot no 70 Watamu as at the date of this order shall be respected and observed by all the parties for a period of 14 days from today, that is until hearing inter-partes on 7/1/2026,” the judge ordered

The court also ordered the petitioner to immediately serve the notice of motion to all respondents, who are required to file their responses within seven days.

The full hearing is scheduled to take place virtually on January 7, 2026.

Mohamed said the court’s action represents a significant step in protecting the park, adding, “This is a big step towards saving Watamu Park,” praising the court’s precautionary approach.

The court orders followed widespread protests by Watamu residents who opposed the government’s decision to cut down trees and build on the public park.

Locals argued that the development threatened the town’s environment, tourism, and community space.

The Ethics and Anti‑Corruption Commission (EACC) has reclaimed a grabbed public road reserve on Mombasa Island valued at approximately KSh21 million, bringing to a close a 17‑year legal fight to return public land intended for vital infrastructure development.

The victory comes after the Environment and Land Court in Mombasa delivered a landmark judgment on December 10,2025 cancelling the fraudulent ownership of land parcel Mombasa Island/Block XI/983.

In a detailed ruling delivered by Justice Stephen Kibunja, the court found that the roadway land, originally reserved for the expansion of Tom Mboya Avenue, had been irregularly and fraudulently allocated to private individuals, nullifying all titles and restoring it to the public domain.

The case dates back to January 18 2008, when the then Kenya Anti‑Corruption Commission (KACC) predecessor to the EACC, filed a suit at the Environment and Land Court after investigations revealed that the road reserve had been unlawfully taken from its designated purpose.

The EACC’s probe showed that the parcel, measuring approximately 0.13 acres, was first allocated through an allotment letter in January 1996 without any formal application, a clear violation of land governance laws.

The court record shows that the allotment was first made to Isaac Munyi Njeru, before the then Land Registrar, Kenneth K. Githii, issued a Certificate of Lease in favour of Julius Mwamsae in 2002 at an annual consideration of KSh 6,000 for a 99‑year term.

In 2003, Mwamsae sold and transferred the lease to Mohamed Mahfudh Saad for KSh 500,000, after which a new Certificate of Lease was issued in Saad’s name.

In his ruling, Justice Kibunja explicitly ordered that the title registered in favour of Saad be cancelled and that the land revert to public ownership so it can be used in accordance with its original purpose.

The judgment also included a permanent injunction restraining Saad “from dealing with the property in any manner other than surrendering it to the government.”

The Environment and Land Court in Nairobi has issued an arrest warrant against Mr. Maurice Asira, the Director of Taks & M Habanos Chill & Grill Limited, trading as Habanos Lounge, for contempt of court following allegations of continued violation of noise pollution laws in the Ridgeways residential area.

The ruling, delivered virtually by Justice Charles Mbogo, found the lounge and its director in breach of court orders issued on October 17, 2024, that had restrained six establishments from playing loud music or emitting noise beyond permissible levels as stipulated under the Environmental Management and Coordination (Noise and Excessive Vibration Pollution) Regulations, 2009.

“It is clear that the 1st respondent(Asira the owner of the club) undermines the authority of this court,” ruled Justice Mbogo.

“When such conduct is brought before the court, it must be dealt with firmly to prevent repetition. The court’s orders are not suggestions, they must be obeyed.”

The case was filed by the Garden & Ridgeways Residents Association (GARRA), citing persistent disturbance from nearby commercial entertainment establishments, including Habanos Lounge.

The association sought redress under constitutional provisions and environmental protection laws.

In their application dated April 7, 2025, the residents asked the court to find Mr. Asira and his company in contempt, arguing that despite being served with court orders and having legal representation during the issuance, the lounge continued to play loud music at night in a residential area.

According to an affidavit by Mary Ann Wariithi, chairperson of GARRA, Habanos Lounge was fully aware of the order, having been served through counsel and official correspondence dated October 30, 2024.

“The 1st respondent has shown no regard for the rights of residents or for the authority of the court. Their actions are deliberate and amount to impunity,” Wariithi stated in her affidavit.

An additional affidavit by Almir Jose Rebeiro De Sousa, a pollution expert and resident, supported the claims with evidence showing noise levels from the lounge exceeded the legal nighttime limit of 35 decibels.

Notably, the 1st respondent — Habanos Lounge — did not file any response or written submissions, a fact the court emphasized in its determination.

“The allegations have gone unanswered,” the judge noted.

“The petitioner’s position has been corroborated with evidence and stands unchallenged. It is apparent the 1st respondent is in contempt.”

The judge further cited Order 40 Rule 3(1) of the Civil Procedure Rules, Section 63(c) of the Civil Procedure Act, and Section 29 of the Environment and Land Court Act, all of which provide for penalties including imprisonment, fines, or both for parties found guilty of contempt.

In April of this year, the National Environment Management Authority (NEMA) ordered the closure of Habanos Lounge following complaints about the club’s uncontrolled noise.

A month later in May, another closure directive was issued to the party spot, still over noise, but the entertainment joint has remained fully operational despite the two directives.

The noise pollution case rose from complaints filed by residents near the facility, who accused the entertainment joint of persistently blasting music above permissible limits despite a restraining order issued on October 17, 2024.

In the final orders, Justice Mbogo directed that: “Mr. Maurice Asira be arrested and arraigned before this court on October 22, 2025, to show cause why he should not be committed to civil jail or otherwise penalized for contempt of court.”

While the application sought jail terms and fines, the judge held that the matter of penalty would be determined after Asira is given a chance to explain himself in court.

The petition involves several popular establishments in the Ridgeways and Garden Estate areas, including The Vineyard, Bar Next Door, DNM Events, Maline Gardens, and Purpose Centre Church Ruach Tabernacle.

Residents have accused the businesses of operating without proper noise control measures, disrupting peace in what is predominantly a residential neighborhood.

The suit also named the Nairobi City County Government and the National Environment Management Authority (NEMA) as respondents for allegedly failing to enforce environmental compliance standards.

In their submissions, the petitioner association argued that: “Unless this court asserts its authority, these establishments will continue flouting the law. Compliance must not be optional.”

Asira is expected to be produced in court next month, where he will be required to respond to the contempt accusations.

If found guilty, he could face up to six months in jail, a monetary fine, or both.

Habanos Lounge could also face corporate penalties under environmental law.
