										<content:encoded><![CDATA[<p>Thirteen matatu saccos have secured temporary relief after the High Court barred Governor Sakaja’s administration and the Energy and Petroleum Regulatory Authority (EPRA) from evicting them from operating at petrol stations in Nairobi’s Central Business District (CBD).</p>
<p>Justice Chacha Mwita directed that, pending the hearing of their constitutional petition, the matatu operators should continue with their operations.</p>
<p>He further ordered that the petitioners serve their petitions upon the Attorney General and EPRA, with the matter scheduled to be heard interparties on 1st December 2025.</p>
<p>The saccos, represented by lawyers Danstan Omari and Stanley Kinyanjui, argued in court that their clients have been operating in the CBD for many years.</p>
<p>They contended that EPRA cannot simply issue eviction orders without providing an alternative location for them to operate from.</p>
<p>“Our clients have invested heavily in operations within the CBD over the years. EPRA cannot wake up one day and order them out without giving them a destination to continue their services,” said Omari.</p>
<p>Through the petition, the operators sought to stop EPRA and Nairobi City County from enforcing a ban on picking and dropping passengers at petrol stations.</p>
<p>They argued that the directives, if enforced, would cripple their operations and disrupt vital public transport services, especially during the peak festive season.</p>
<p>The petitioners who include ENA Coach, Easy Coach, Mololine, North Rift, GTS Supreme Sacco, Nenus Shuttle, Transline Classic, Prestige Limited, Kangema Sacco, and Super Premium T&amp;T described the sudden orders as abrupt, procedurally flawed, and economically damaging.</p>
<p>They also questioned why Nairobi commuters are being singled out, noting that similar services in other parts of the country continue unhindered.</p>
<p>In court, the operators highlighted that EPRA’s shutdown order had thrown the matatu industry into confusion, threatening the livelihoods of thousands who rely on these stations as critical pick-up and drop-off points.</p>

										<content:encoded><![CDATA[<p>Lugari Member of Parliament Nabii Nabwera has urged the Directorate of Criminal Investigations (DCI) to launch an immediate probe into the mysterious abduction of Munyuki High School Principal, Simon Isiaho Shange, who disappeared nearly a week ago.</p>
<p>Speaking through his lawyer Danstan Omari, Nabwera appealed to DCI boss Mohammed Amin to “move with speed and establish the whereabouts” of the missing principal, who was allegedly abducted shortly after being involved in a road accident on November 3, 2025.</p>
<p>“The Principal has not been seen in Lugari Constituency for six days now. His family and colleagues are deeply worried as he has not communicated with anyone since the day of his disappearance,” said Mr. Omari during a press briefing in Nairobi.</p>
<p>According to Omari, witnesses reported that soon after the accident, unknown individuals whisked away the principal to an undisclosed location.</p>
<p>The lawyer further revealed that his client has been linked to the incident by bloggers, whom he now accuses of defamation.</p>
<p>“We have written to three individuals, Peter Amunga, George Opunga Tamata, and Simon Asievela, demanding they immediately pull down defamatory posts on X (formerly Twitter) alleging that the MP was involved in the abduction,” Omari stated.</p>
<p>He said failure to comply will see the MP demand KSh 20 million in damages from each of the bloggers.</p>
<p>“If they do not retract and apologize, we will file a defamation suit claiming KSh 20 million from each of them on behalf of Hon. Nabwera,” Omari warned.</p>
<p>Omari confirmed that he had officially written to the DCI seeking urgent investigations into the abduction, noting that the matter has caused public anxiety in the constituency.</p>
<p>“This is not a political issue, it’s a serious matter of human rights and personal safety. We want the DCI to get to the bottom of it,” he said.</p>
<p>The MP, who is currently in the United Kingdom attending a parliamentary conference, has reportedly maintained communication with his legal team and security agencies from abroad.</p>
<p>“My client has nothing to hide. He only wants the truth to come out and the principal safely found,” Omari affirmed.</p>
<p>As investigations continue, police are yet to issue an official statement on the missing school head’s whereabouts.</p>

										<content:encoded><![CDATA[<p>A lobby group has moved to court seeking to stop the government’s planned recruitment of 10,000 police officers, arguing that the payroll system into which the new officers would be absorbed is under disputed control.</p>
<p>Sheria Mtaani na Shadrack Wambui, a civil society organization, filed the constitutional petition at the Milimani High Court, challenging the Inspector General’s authority over payroll management in the National Police Service.</p>
<p>Through lawyer Danstan Omari, the group argues that payroll functions fall under the constitutional mandate of the National Police Service Commission (NPSC), not the office of the Inspector General (IG), which is limited to operational command.</p>
<p>“This petition is about constitutional accountability,” Omari told the court.</p>
<p>“The IG cannot be allowed to usurp human resource powers through payroll control. That function belongs to the Commission, as clearly provided under Article 246 of the Constitution.”</p>
<p>The petition, which has been certified as urgent, warns that allowing recruitment to proceed under a disputed payroll regime could entrench unconstitutional practices.</p>
<p>“Payroll is not just about salaries. It reflects promotions, transfers, suspensions, and disciplinary actions,” the petition states.</p>
<p>“Allowing the Inspector General to run it undermines transparency and removes civilian oversight.”</p>
<p>According to the lobby group, the timing of the recruitment makes the case especially critical.</p>
<p>They argue that once the 10,000 new recruits are entered into the payroll system, any ruling by the court may become ineffectual.</p>
<p>“If this court does not intervene now, the process will be irreversible,” said Omari. “You cannot recall appointments and payroll entries once they have been activated under an unlawful system.”</p>
<p>The respondents in the case include the Inspector General of Police, the National Police Service, and the Attorney General.</p>
<p>The National Police Service Commission and the Law Society of Kenya have been named as interested parties.</p>
<p>Court records show that all parties were served with the petition on August 14, 2025, but none had filed a response by the time of the court’s preliminary hearing.</p>
<p>“The silence from the respondents only deepens the urgency of this matter,” Omari submitted.</p>
<p>“We urge the court to issue conservatory orders stopping the recruitment pending full determination of this petition.”</p>
<p>The group wants the court to hear the matter during recess, warning that any delay could lead to “constitutional violations being cemented.”</p>
<p>The lobby insists that payroll is a core element of police human resource management and that placing it under the operational command of the IG would create a conflict of interest and weaken institutional checks and balances.</p>
